Terms of Service

1. Definitions
- "Service" — The dailyOps platform, including the web application, all APIs, and related services.
- "User" or "You" — Any individual who creates an account or accesses the Service.
- "Organization" — The restaurant or food service business registered on dailyOps, operating in an isolated data environment.
- "Content" — All data, text, images, and records uploaded to or created within the Service.
- "Subscription" — The paid plan (Essenziale or Completo) granting access to features.
2. Acceptance of Terms
By creating an account or using dailyOps, you agree to these Terms, our Privacy Policy, Cookie Policy, Acceptable Use Policy, and Pricing Policy. Using dailyOps on behalf of an organization means you represent authority to bind that organization.
3. Eligibility
You must be at least 18 years old, authorized to act on behalf of your business, operate a food service business subject to EU/UK food safety regulations, and provide accurate registration information.
4. Account Responsibilities
You must provide truthful information, maintain password security, ensure team members comply with these Terms, and notify us immediately of suspected unauthorized access.
5. Service Description
dailyOps is a digital HACCP compliance platform providing core registers (temperature, lots, cleaning, expiry, non-conformity, suppliers, cooking, calibration, pest control), AI-assisted label scanning, AI chat assistant, inspection mode with PDF export, team management with role-based access, task assignment, and audit trail.
6. Subscription & Billing
dailyOps offers Essenziale (€49/month or €39/month annual) and Completo (€99/month or €79/month annual) plans. Each organization receives a 14-day free trial. Subscriptions auto-renew monthly or annually. All payments processed by Stripe in EUR. See our Pricing Policy and Refund Policy for full details.
7. Feature Gating & Downgrades
Certain features are Completo-only: preparations with portions, training register, AI chat, unlimited scans, unlimited staff, priority support. On downgrade, data is preserved and gated features become read-only. Usage exceeding plan limits requires upgrade or reduction.
8. AI Features — Disclaimer
AI features (label scanning, chat assistant) provide informational suggestions only. They are not professional food safety advice, not a substitute for trained HACCP consultants, and not guaranteed to be accurate. You are responsible for verifying all AI-extracted data and ensuring record accuracy.
9. Data Ownership & License
You retain full ownership of all Content. You grant dailyOps a limited license to process and display your Content solely for service delivery. The Service itself (design, code, branding) is dailyOps intellectual property.
10. Multi-Tenant Isolation
Each Organization's data is completely isolated. All queries are scoped by organization ID. No cross-tenant access is possible. Team members access only their own Organization's data.
11. Acceptable Use
Use is subject to our Acceptable Use Policy. You may not use the Service for non-food-safety purposes, upload harmful content, access other organizations' data, or circumvent billing or feature gates. Violations may result in account suspension or termination.
12. Limitation of Liability
We do not guarantee uninterrupted service. We are not liable for inspection outcomes, regulatory fines, food safety incidents, or decisions based on AI suggestions. Total liability is limited to amounts paid in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
13. Indemnification
You agree to indemnify dailyOps from claims arising from your use of the Service, violation of these Terms, Content you upload, or negligence in maintaining food safety records.
14. Termination
You may cancel anytime. We may suspend or terminate accounts for Terms violations, unresolved payment failures, security threats, or legal requirements. Upon termination, data is preserved for export; you may request export or deletion.
15. Governing Law
These Terms are governed by the laws of the European Union. Disputes are subject to the jurisdiction specified in our full Terms document.
16. Dispute Resolution
Both parties agree to attempt good-faith negotiation for at least 30 days before formal proceedings. Either party may seek injunctive relief to protect their rights.
17. Force Majeure
Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or third-party service failures.
18. Changes to These Terms
Material changes will be notified via email at least 30 days before taking effect. Continued use constitutes acceptance. You may cancel before changes take effect if you disagree.
19. Severability
If any provision is found invalid, the remaining provisions continue in full force. The invalid provision will be modified to the minimum extent necessary.
20. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, Pricing Policy, and Refund Policy, constitute the entire agreement.
